Have you been injured at work?

If you have been injured at work make sure to report it to your management team as soon as possible after the injury happened so that it can be logged and reported to their claims dept. NO injury is to small to report.

You have rights as a injured worker, you have the right not to be treated differently and the right for medical care from your employers workman’s comp insurance. Please note you will not get rich being out on WC Leave. you will get 2/3rd of your regular pay and all of your medical and transportation to and from the doctor appts for that INJURY paid for.( you must keep a record of mileage and dates of appts in order to report to get reimbursed)

Make sure to go to all of your scheduled appts unless there is a legit reason for you not to make that appointment, make sure you call to cancel and reschedule your appointment. you can not heal and get the medical attention that you need if you miss appointments. Follow the directions as much as possible so that you can heal faster and get back to work.

If you are put on light duty at you return to work make sure you follow those light duty orders, your employer may forget what is on the list, however you have a copy of the light duty and you can remind your employer that you are not allowed to do something in the event that they ask you to do it, remember your health and recovery is your responsibility to make sure you are not hurting yourself more. If you are doing something that is allowed on your light duty list and you begin to hurt document the time and what you were doing that was hurting you, tell your doctor and your employer. Remember your injury can cause a mirror effect on the limbs that you are using to make up for the parts of your body that you are not using, take it easy however do the best that you can at work.

Legal Representation is also your right and it is best to have when you have a work injury, once again you will not get rich off a work injury so please do not hurt yourself at work on purpose. When you have Legal Representation that is to make sure your rights are not abused and that you are getting the fair shake on things, most WC Attorneys are paid only if you have a claim settled and each state has a set percentage that they can be paid, no claim settled no payment. Also you do not know all of the language that is/will be used in your paperwork. Once you have hired Legal Representation the claims adjuster may not contact you any further.

Do not fear about losing your job, however you must go to work(unless you are sick) you must follow all of your company guidelines regardless of your injury. Do not think just because you are injured you do not have to listen to your managers, yes , you do not have to do things that your doctor told you not to do, however be nice and remind your manager about the light duty list, your manager did not hurt you.
